These Terms of Service ("Terms") govern your subscription to Nomad Post Art, a monthly art letter created by Paloma Kaiper. Nomad Post Art is operated by Paloma Kaiper, registered in Brazil as a Microempreendedor Individual under CNPJ 48.959.193/0001-39 ("we", "us"). By subscribing, you agree to these Terms.
Nomad Post Art is a monthly subscription. Each month, we post one physical letter to the address you provide. Each letter is sent from the country where Paloma is travelling and working that month. The contents of each letter are described on our website and may vary slightly from month to month, because they depend on the place and the artwork made there.
Shipping is included in the price. Your bank or card provider may charge currency conversion or foreign transaction fees; these are outside our control. We may change prices in the future. If we do, we will tell you by email at least 30 days before the new price applies, and you can cancel before then.
Your subscription renews automatically every month on the same date as your first payment, until you cancel. By subscribing, you authorise us, through our payment provider, to charge your payment method each month. If a payment fails, we may pause your subscription until it is resolved.
You can cancel at any time, with no fees. Worldwide subscribers can cancel through the subscription management link included in every payment email. Brazilian subscribers can cancel through their Mercado Pago account. You can also email us and we will cancel it for you. When you cancel, no further payments are taken. If you have already paid for the current month, you will still receive that month's letter.
Because each letter is handmade and prepared specifically for each month's edition, payments for letters that have already been prepared or posted are not refundable, except where the law requires otherwise or in the cases described in section 7.
If you are a consumer in the European Union, the United Kingdom or Brazil, you have the right to withdraw from your subscription within 14 days (EU/UK) or 7 days (Brazil) of subscribing, by emailing us. If your first letter has not been posted yet, we will refund you in full. If it has already been posted, we may deduct the value of that letter from the refund, as permitted by law.
Letters are sent by standard international post, without tracking unless stated otherwise. Delivery times depend on the country of origin, your country and local postal services, and usually range from 1 to 6 weeks. We are not responsible for delays caused by postal services or customs. Please make sure your address is complete and correct; we cannot resend letters returned or lost because of an incorrect address.
If your letter has not arrived within 8 weeks of the posting date we announce, or arrives seriously damaged, email us. We will do our best to send a replacement or, if that is not possible, refund that month's payment.
To change your delivery address, email us before the letter for the next month is posted. Changes received after posting will apply to the following letter.
All artwork, prints, photographs, texts and stickers are original works by Paloma Kaiper and remain her property. Your subscription gives you ownership of the physical items for personal use. It does not give you the right to reproduce, sell or use the artwork commercially. You are welcome to share photos of your letter and your coloured copy on social media.
Because Nomad Post Art depends on travel, we may occasionally need to change the country of origin, delay a posting date or adjust the contents of a letter. If we cannot post a letter in a given month, you will not be charged for that month, or you will receive a refund.
To the extent permitted by law, our total liability to you for any claim related to the service is limited to the amount you paid in the three months before the claim. Nothing in these Terms limits any rights you have as a consumer under the laws of your country.
We may update these Terms. If the changes are significant, we will tell you by email before they apply. Continuing your subscription after that means you accept the updated Terms.
These Terms are governed by the laws of Brazil. If you are a consumer living in another country, you also keep the protection of the mandatory consumer laws of your country.
